Digest of COSHAB's Decision After Reconsideration dated January 24, 1985, Docket No. 79-R2D5-535. Elaine W. Donaldson, Chairman; L. A. Harrington and Alfred H. Song, Members.

The Appeals Board affirmed the ALJ decision of December 19, 1979 (Digest 13,642) denying Employer's appeal from a serious violation of 3203(a)(1) (accident prevention program). In affirming the violation as serious, the Board held that failure to instruct employees about certain safety hazards may be a serious violation (despite language to the contrary in Western Yarns, Inc., (Digest 16,011), ALJ decision of 1-23-85 (above)).
