Digest of COSHAB's Decision After Reconsideration dated September 26, 1985, Docket Nos. 82-R1D5-144 and 145. Elaine W. Donaldson, Chairman; L. A. Harrington and Michael R. Monagan,Members.

The Appeals Board affirmed the ALJ decision of November 17, 1982 (Digest 15,207), denying Employer's appeals from existence of a repeat/general violation of 1592(a) (warning methods) and a repeat/serious violation of 1541(a) (trenches). The Board also affirmed the ALJ in assessing penalties of $500 and $600 respectively.
