CAL. CODE REGS, tit. 8, § 3314(a) (2001) - The Appeals Board reversed an ALJ decision granting Employer's appeal. Employer failed to block out a cement mixer's blades to prevent inadvertent movement and, even though it had locked out the motor, the blades were capable of movement and caused a fatal accident.
