MULTI-EMPLOYER WORK SITES - CITATION POLICY
CAL. CODE REGS, tit. 8, § 336.11 (2002) - The Appeals Board held that the ALJ's finding of a safety order violation was not precluded by the Division's failure to determine whether Employer met the five required defense elements available to multi-employer worksite employers before issuing the citation. The Board also determined that the section could be asserted as an affirmative defense to a safety order violation, but disagreed with Employer's interpretation of the section.
