EARTHMOVING EQUIPMENT - BACK-UP ALARMS
CAL. CODE REGS, tit. 8, §§ 3328(g) and 1592(b) (2002) - The Division failed to prove that nonfunctioning back-up alarms on two excavators were in violation of either the cited general industry requirement to maintain equipment in safe condition, or a construction order, not cited, requiring protecting workers on foot from the hazard of backing equipment. There was no employee exposure established, and Employer had alternative acceptable methods of protection in place.
