CAL. CODE REGS, tit. 8, § 3942(a) (2002) - The Appeals Board agreed with the ALJ that the open guard door on an earth-boring machine's soil ejector was not secured as required by the safety order. The Board also found that the open door did not meet the requirement that guarding be appropriate.
