REPORTING - SERIOUS INJURY
Cal. Code Regs, tit. 8, § 342(a) (2012) - Exigent circumstances existed that extended the permissible reporting time to 24 hours after Employer learned of the serious nature of the employee’s injury.

WOODWORKING MACHINES AND EQUIPMENT - TABLE SAWS
Cal. Code Regs, tit. 8, § 4300.1(a)(1) (2012) - One side of Employer’s table saw hood rested on the fence rather than on the wood during the work that a carpenter was doing at the time of his injury. The failure of the hood to rest entirely on the piece being cut violated §4300.1(a). However, the Division failed to establish the serious classification of the violation, which was reclassified and the penalty reduced accordingly.

WOODWORKING MACHINES AND EQUIPMENT - KICKBACK
Cal. Code Regs, tit. 8, § 4300.1(c)(1) (2012) - The anti-kickback devices within the table saw guard were not effective for all thicknesses of material, as required by §4300.1(c)(1), which applied despite the “Class B” limitation of §4188. Employer violated §4300.1(c)(1) by its use of the table saw for this operation. However, the Division failed to establish the serious classification of the violation, which was reclassified and the penalty reduced accordingly.
