POWER OPERATED PRESSES – PRESS BRAKES MECHANICALLY OR HYDRAULICALLY POWERED
Cal. Code Regs, tit. 8, § 4214(a) (2015) – Employer stipulated that it failed to ensure that six press brakes were guarded at the point of operation, resulting in an employee’s injury.

VIOLATION – WILLFUL CLASSIFICATION
Cal. Code Regs, tit. 8, § 334(e) (2015) – Employer disregarded a prior order, which was the identical citation issued in this matter. It failed to implement alternative means of guarding or follow safe practices in using hand tools when not using a guard. The Division established Employer’s actual knowledge and that Employer intended to violate the safety order, which established the willful classification.
