46 COR 40-8097 [¶22,897] SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – DOCK PLATES AND LOADING RAMPS, CONSTRUCTED AND MAINTAINED WITH STRENGTH SUFFICIENT TO SUPPORT LOAD CARRIED Cal. Code Regs, tit. 8, § 3337(a) (2018) – Employer’s dock plates were not maintained with sufficient strength to support the load carried on them, a general violation.  GENERAL MOBILE EQUIPMENT AND AUXILIARIES – INDUSTRIAL TRUCKS, TRACTORS, HAULAGE VEHICLES, AND EARTHMOVING EQUIPMENT, NAME PLATES Cal. Code Regs, tit. 8, § 3650(b)(4) (2018) – Name plates on Employer’s forklifts were illegible, a general violation. GENERAL MOBILE EQUIPMENT AND AUXILIARIES – INDUSTRIAL TRUCKS, TRACTORS, HAULAGE VEHICLES, AND EARTHMOVING EQUIPMENT, OPERATED IN SAFE MANNER Cal. Code Regs, tit. 8, § 3650(t)(7) (2018) – Tires on a forklift being used by Employer’s employees were damaged, a general violation. GENERAL MOBILE EQUIPMENT AND AUXILIARIES – INDUSTRIAL TRUCKS, TRACTORS, HAULAGE VEHICLES, AND EARTHMOVING EQUIPMENT, BRAKES AND WARNING DEVICES Cal. Code Regs, tit. 8, § 3661(c) (2018) – A forklift did not have a horn, a general violation.  GENERAL PHYSICAL CONDITIONS AND STRUCTURES ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) Cal. Code Regs, tit. 8, § 3203(a)(1) (2018) – The Division did not establish that Employer failed to implement and maintain an effective IIPP. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – LOADING DOCK OPERATIONS, SECURED AGAINST UNINTENDED MOVEMENTS Cal. Code Regs, tit. 8, § 3336(a) (2018) – The Division failed to establish that Employer’s trailers were not secured against unintended movement.  SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – FOOT PROTECTION Cal. Code Regs, tit. 8, § 3385(a) (2018) – Employer’s employees were not provided with appropriate foot protection. The ALJ reclassified the violation from serious to general.  GENERAL MOBILE EQUIPMENT AND AUXILIARIES – INDUSTRIAL TRUCKS, TRACTORS, HAULAGE VEHICLES, AND EARTHMOVING EQUIPMENT, BRAKES AND WARNING DEVICES, PARKING BRAKE Cal. Code Regs, tit. 8, § 3661(b) (2018) – Employer failed to equip industrial trucks with a parking brake or other effective device to prevent the vehicle from moving when unattended, a serious violation.
