Code Regs, tit. 8, § 1632(b)(3) (2019) – Reversing an ALJ decision, the Appeals Board concluded the Division established a serious violation for failure to adequately guard a ceiling opening, but not the accident-related characterization. The penalty was reinstated. VIOLATION – SERIOUS CLASSIFICATION Labor Code § 6432 (2019) – The Appeals Board reversed an ALJ decision that Employer overcame the presumption of a serious violation by demonstrating it did not know and could not, with reasonable diligence, have known of the violation. The Appeals Board found that Employer failed to take all steps a reasonable and responsible employer would take to anticipate and prevent a fall through an opening.
