Cal. Code Regs, tit. 8, §§ 1509(a), 3203(a)(4) (2015) – The Division did not establish that Employer failed to implement the part of its IIPP requiring it to identify and evaluate workplace hazards.

FLOOR, ROOF AND WALL OPENINGS TO BE GUARDED – FLOOR, ROOF AND SKYLIGHT OPENINGS GUARDED BY TEMPORARY RAILINGS AND TOEBOARDS OR COVERS
Cal. Code Regs, tit. 8, § 1632(b)(1) (2015) – Employer failed to guard a roof opening, which resulted in a serious injury. However, the ALJ reclassified the violation from serious to general and recalculated the penalty, based on Employer’s reasonable diligence.
