AGRICULTURAL TRACTORS - OPERATOR AT CONTROLS OF SELF-PROPELLED Cal. Code Regs, tit. 8, § 3441(b) (2010) - Employer’s employees were exposed to the hazard of a self-propelled harvesting machine that did not have an operator attending the controls or alternate controls. The Division established a violation, but not that a serious injury was more likely than not to occur in the event of an accident caused by the violation. The ALJ reclassified the violation and reduced the penalty.
