ACCESS, WORK SPACE, AND WORK AREAS – AISLES, WALKWAYS, AND CRAWLWAYS
Cal. Code Regs, tit. 8, § 3272(c) (2016) – Employer failed to keep a walkway reasonably clear, a serious, accident-related violation. The path the employee took to get to a ladder, in order to get from a loading dock to the ground below, was a “walkway” because it was used as walkway.
INDEPENDENT EMPLOYEE ACTION DEFENSE (IEAD)
Employer failed to establish several elements of the IEAD with respect to an employee’s use of a walkway prior to his fall onto a concrete surface below a loading dock.
