SAFE PRACTICES AND PERSONAL PROTECTION, PERSONAL SAFETY DEVICES AND SAFEGUARDS – HEAT ILLNESS PREVENTION, TRAINING Cal. Code Regs, tit. 8, § 3395(h)(1) (2020) – Employer failed to provide heat illness training to an employee before the employee began work that should be reasonably be anticipated to result in exposure to the risk of heat illness, a general violation. SAFE PRACTICES AND PERSONAL PROTECTION, PERSONAL SAFETY DEVICES AND SAFEGUARDS – HEAT ILLNESS PREVENTION PLAN (HIPP) Cal. Code Regs, tit. 8, § 3395(i)(1) (2020) – Employer produced its HIPP that was in compliance with the safety order and in effect at the time of the inspection. The Division failed to establish a violation. CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) Cal. Code Regs, tit. 8, § 1509(a) (2020) – Employer did not provide training on workplace hazards to employees exposed to those hazards, a serious violation. However, the ALJ reduced the proposed penalty based on adjustment factors and credits. CONSTRUCTION SAFETY ORDERS – SCAFFOLDS, SCAFFOLD DESIGN AND CONSTRUCTION, MANUFACTURED SCAFFOLDS Cal. Code Regs, tit. 8, § 1637(b)(4) (2020) – The Division presented no evidence that Employer failed to use a bracket scaffold in accordance with manufacturer’s recommendations and, thus, failed to establish a violation. CONSTRUCTION SAFETY ORDERS – SCAFFOLDS, OUTRIGGER AND BRACKET SCAFFOLDS, RAILINGS Cal. Code Regs, tit. 8, § 1645(d)(3) (2020) – Employer did not install railings on all bracket scaffolds, a serious violation. However, the ALJ reduced the proposed penalty based on adjustment factors and credits.
