CITATION - MULTI-EMPLOYER POLICY
Cal. Code Regs, tit. 8, §§ 336.10 and 3329(d); Labor Code § 6400(b)(3) (2013) - There was no evidence that the work being carried out by the subcontractor at the time of the accident required general contractor involvement, nor that Employer was aware that the work undertaken by the subcontractor’s employee that led to the injury involved internal pressure that should have been relieved to prevent sudden release of pressure or spraying of liquid. Employer, as a result, was not the controlling employer with respect to the alleged violation.
