REQUIRMENTS FOR IMPALEMENT PROTECTION Cal. Code Regs, tit. 8, § 1712(c)(1) (2022) – The Division’s evidence indicated a reasonable likelihood that employees could access the stop work areas, inadvertently or otherwise, and thus came within the zone of danger in the vicinity of the exposed rebar. The Board affirmed the citation. REQUIREMENTS FOR IMPALEMENT PROTECTION – DEFINITION OF “WORKING” Cal. Code Regs, tit. 8, § 1712(c)(1) (2022) – The Board defined “working” in the Safety Order to include the full range of activities engaged in by employees while performing work-related duties, pursuing personal activities during work, or employing normal means of ingress and egress to their work stations. ASSESSMENT OF CIVIL PENALTIES Cal. Code Regs, tit. 8, § 336(b) (2022) – The violation was classified as General and a penalty of $1200 was assessed by the ALJ. Employer did not contest the classification or penalty. The Board affirmed the citation and penalty.
