Code Regs, tit. 8, § 342(a) (2018) – Employer provided no justification for its untimely report of an employee’s serious injury. Employer violated the safety order, but was entitled to penalty reduction. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – CONTROL OF HAZARDOUS ENERGY FOR CLEANING, REPAIRING, SERVICING, SETTING-UP, AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT, TRAINING Cal. Code Regs, tit. 8, § 3314(l)(2) (2018) – An employee who was injured while using an industrial machine did not receive any formalized training on the purpose and use of the energy control procedure. Employer violated the safety order. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – CONTROL OF HAZARDOUS ENERGY FOR CLEANING, REPAIRING, SERVICING, SETTING-UP, AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT, CLEANING, SERVICING AND ADJUSTING OPERATIONS Cal. Code Regs, tit. 8, § 3314(c) (2018) – Section 3314(c)(1) was the applicable safety order, where the equipment at issue was deliberately energized.
