Code Regs, tit. 8, § 1541(i)(2)(A-C) (2016) – The Division failed to establish that Employer violated the safety order by excavating below the level of the base or footing of any foundation or retaining wall that could reasonably be expected to pose a hazard to employees working inside the excavation.
