OCCUPATIONAL SAFETY AND HEALTH APPEALS BOARD – BASIS FOR RECONSIDERATION Labor Code § 6617 (2022) -  Employer’s petition failed to assert grounds upon which the Board may have considered reconsideration. OCCUPATIONAL SAFETY AND HEALTH APPEALS BOARD – FILING AN INTENT TO APPEAL AND LATE APPEALS California Code of Regulations, title 8, § 359(e) (2022) - The time for filing any appeal may be extended or a late filing permitted upon a written showing of good cause that contains sufficient facts to show or establish a reasonable basis for the late filing. Employer failed to demonstrate good cause for its late filing, resulting in denial of the petition. OCCUPATIONAL SAFETY AND HEALTH APPEALS BOARD – SERVICE OF PETITION ON ALL PARTIES Labor Code § 6619 (2022) -  A petition for reconsideration must be served on the opposing party. Failure to satisfy that requirement was additional grounds to deny the petition.
