INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) Cal. Code Regs, tit. 8 §3203(a)(2) (2009) - A crane operator failed to “float the load” prior to hoisting a container, which resulted in a serious injury to an employee. This constituted a violation of the IIPP safety order.
DEFENSES - INDEPENDENT EMPLOYEE ACTION Employer did not effectively enforce its safety program. Because Employer failed to satisfy all five elements, it did not establish the independent employee action defense.
