OCCUPATIONAL SAFETY AND HEALTH APPEALS BOARD – FILING AN INTENT TO APPEAL AND LATE APPEALS. California Code of Regulations, title 8, § 359(d) (2022) - The time for filing any appeal may be extended or a late filing permitted upon a written showing of good cause that contains sufficient facts to show or establish a reasonable basis for the late filing. Employer failed to demonstrate good cause for its late filing, resulting in denial of the petition. OCCUPATIONAL SAFETY AND HEALTH APPEALS BOARD – RECONSIDERATION. California Code of Regulations, title 8, § 390.1(a)(4) (2022) - Discovery of new evidence, which the petitioner did not know about, and could not have known about through the exercise of reasonable diligence at the time of the hearing, is grounds for reconsideration.
