INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – PROCEDURES FOR IDENTIFYING AND EVALUATING WORKPLACE HAZARDS
Cal. Code Regs, tit. 8, § 3203(a)(4) and (a)(6) (2017) – The Division failed to establish that Employer did not identify and evaluate workplace hazards, identify unsafe conditions and work practices, or correct unsafe conditions and/or work practices in accordance with its IIPP.

GEARS, FRICTION DRIVES, SPROCKETS, AND CHAINS – GEARS AND SPROCKETS, GUARDING
Cal. Code Regs, tit. 8, § 4075(a) (2017) – The Division failed to establish that Employer did not guard all gears, sprockets and sprocket chain drives located seven feet or less above the floor or working level.

CLEANING, REPAIRING, SERVICING AND ADJUSTING PRIME MOVERS, MACHINERY AND EQUIPMENT – CLEANING, SERVICING AND ADJUSTING OPERATIONS
Cal. Code Regs, tit. 8, § 3314(c) (2017) – The citation for failure to ensure that employees adequately blocked out the moveable parts on a filling machine to prevent inadvertent movement or release of stored energy while performing periodic maintenance, or failed to place accident prevention signs or tags on the controls of the power source of the machinery or equipment, was dismissed. Employer established the independent employee action defense.
