INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – NEW OR PREVIOUSLY UNRECOGNIZED HAZARD
Cal. Code Regs, tit. 8, § 3203(a)(4)(C) (2016) – The Division demonstrated the existence of a “new or previously unrecognized hazard,” the weather conditions at a specific worksite in conjunction with the employee’s lack of experience and training. Employer also failed to conduct an inspection of the new or unrecognized hazard.

TELECOMMUNICATION SAFETY ORDERS – INCLEMENT WEATHER
Cal. Code Regs, tit. 8, § 8602(i) (2016) – Employer failed to discontinue work from structures when adverse weather made the work unsafe. In evaluating whether adverse weather renders work unsafe, an employer must additionally reasonably consider the impact that existing weather conditions are likely to have on the assigned employee. The employer must consider factors such as the particular work being done, the location of the work, and the experience, skill, and training of the assigned employee.
