Cal. Code Regs, tit. 8, §§ 5189(j)(2)(B) and 5189(j)(2)(C) (2010) - Employer neither tested its chlorine and sulfur dioxide gas detectors using recognized and generally accepted engineering practices nor conducted corresponding inspections and tests with required frequency. The Division established the violations, but the ALJ reduced the penalty for each violation.

Cal. Code Regs, tit. 8, § 3310(d) (2010) - The Division did not establish that the cited condition exposed employees to chlorine gas.

Cal. Code Regs, tit. 8, § 5162(c) (2010) - The Division did not establish that the cited condition exposed employees to chlorine gas, and therefore did not establish the alleged violation.
