Cal. Code Regs, tit. 8, § 6614(a) (2016) – The Board lacked jurisdiction over Employer’s untimely petition for reconsideration.
PETITION FOR RECONSIDERATION – SETTLEMENT
Labor Code § 6617(d) (2016) – A decision after reconsideration is not “evidence” within the meaning of Labor Code §6617(d). As a result, Employer was not entitled to avoid its negotiated settlement with the Division on grounds of “new evidence” that it could not have discovered and produced at hearing.
