INJURY AND ILLNESS PREVENTION PROGRAM (IIPP)
Cal. Code Regs, tit. 8, §§ 3203(a)(4), (a)(6), (a)(7) (2016) – Employer failed to implement its IIPP. A hazard existed when an employee was cutting small pieces on a foot-operated shear. Employer was aware of the hazard, but the injured employee was not trained about it.

POINTS OF OPERATION AND OTHER HAZARDOUS PARTS OF MACHINERY – FOOT-OPERATED DEVICES
Cal. Code Regs, tit. 8, § 4185 (2016) – Employer failed to guard its foot-operated shear from unintended operation, a serious violation.

POINTS OF OPERATION AND OTHER HAZARDOUS PARTS OF MACHINERY – METAL SHEARS, MECHANICAL POWER AND FOOT AND HAND POWER METAL SHEARS PROVIDED WITH GUARD
Cal. Code Regs, tit. 8, § 4227(a) (2016) – Employer’s shear did not have a guard to prevent the fingers of the operator from entering the zone traveled by the knives of the shear while they were in motion, a serious, accident-related violation.

POINTS OF OPERATION AND OTHER HAZARDOUS PARTS OF MACHINERY – CHAINS, BARRIERS OR OTHER MEANS OF GUARDING PROVIDED TO PREVENT ENTRY TO REAR OF SHEAR DURING OPERATION
Cal. Code Regs, tit. 8, § 4227(e) (2016) – Employer’s shear did not have a chain, barrier, or other means of guarding to prevent entry to the rear of the shear during operation. However, the penalty for the violation was eliminated as duplicative.
