45 COR 40-8067 [¶22,877] REPORTING WORK-CONNECTED INJURIES – REPORTING WORK-CONNECTED FATALITIES AND SERIOUS INJURIES Cal. Code Regs, tit. 8, § 342(a) (2018) – An employee did not contract Valley Fever in connection with his employment. As a result, the Division failed to establish that Employer was obligated to report the employee’s illness to the Division. INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – DOCUMENTATION Cal. Code Regs, tit. 8, § 3203(a) (2018) – Although Employer investigated an employee’s complaint of Valley Fever, it failed to document the investigation, in violation of the safety order. The ALJ reclassified the violation from serious to general. CONTROL OF HAZARDOUS SUBSTANCES – DUSTS, FUMES, MISTS, VAPORS AND GASES – CONTROL OF HARMFUL EXPOSURE TO EMPLOYEES Cal. Code Regs, tit. 8, § 5141(a) (2018) – The Division did not establish that Employer failed to prevent harmful exposure through its watering methods for dust suppression, nor did its investigation appropriately assess whether the engineering controls Employer used on its inventory piles caused harmful exposure to its employees.
