46 COR 40-8183 [¶22,964R]

CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) Cal. Code Regs, tit. 8, § 1509(a), Labor Code § 6317 (2019) – The Appeals Board dismissed a citation that alleged Employer failed to effectively implement and maintain its IIPP. The Division failed to describe the nature of the violation with sufficient particularity. CONSTRUCTION SAFETY ORDERS – STANDARD RAILINGS, DESIGN AND CONSTRUCTION OF RAILINGS Cal. Code Regs, tit. 8, § 1620(a) (2019) – The Division established multiple instances at Employer’s jobsite where a top rail and mid-rail did not meet required measurements, a serious violation. The ALJ properly rejected Employer’s contention that it had substantially complied with the safety standard. CONSTRUCTION SAFETY ORDERS – ERECTION AND CONSTRUCTION, PROTECTION FROM REINFORCING STEEL AND OTHER SIMILAR PROJECTIONS Cal. Code Regs, tit. 8, § 1712(c)(1) (2019) – Employer failed to guard all exposed ends of protruding reinforcing steel or other similar projections with protective covers or troughs, a serious violation.
