Cal. Code Regs, tit. 8, § 3314(g)(2)(A) (2017) – Employer did not have separate procedural steps for safe lockout/tagout of an escalator, and failed to establish that an exception to the safety order applied.

CONTROL OF HAZARDOUS ENERGY FOR CLEANING, REPAIRING, SERVICING, SETTING-UP, AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT – CLEANING, SERVICING AND ADJUSTING OPERATIONS
Cal. Code Regs, tit. 8, § 3314(c) (2017) – The Board granted Employer’s appeal of a citation for failure to lock out an escalator prior to servicing operations. The escalator was placed in motion deliberately; therefore, its energization or start-up was not “unexpected” and §3314 did not apply.

PRIME MOVERS AND MACHINERY – MOVING PARTS OF MACHINERY OR EQUIPMENT, GUARDING
Cal. Code Regs, tit. 8, § 4002(a) (2017) – The safety order did not apply because its guarding requirement pertained to the ordinary condition of machinery, not to machinery partially dismantled and in the process of maintenance and repair.
