REPORTING WORK-CONNECTED INJURIES – REPORTING WORK-CONNECTED FATALITIES AND SERIOUS INJURIES Cal. Code Regs, tit. 8, § 342(a) (2021) –  The Division failed to establish Employer did not timely report an employee’s serious injury. There was no evidence the employee contracted Valley Fever while working at Employer’s site. CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP), EFFECTIVELY IDENTIFYING, EVALUATING AND CONTROLLING HAZARDS Cal. Code Regs, tit. 8, §§ 1509(a), 3203(a)(4) (2021) –  The Division failed to establish Employer did not effectively identify, evaluate, and control hazards related to Valley Fever. CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP), TRAINING Cal. Code Regs, tit. 8, §§ 1509, 3203(a)(7) (2021) – The Division failed to establish Employer did not provide training on hazards related to Valley Fever. CONTROL OF HAZARDOUS SUBSTANCES – DUSTS, FUMES, MISTS, VAPORS AND GASES, RESPIRATORY PROTECTION, PERMISSIBLE PRACTICE Cal. Code Regs, tit. 8, § 5144(a)(1) (2021) –  The Division failed to establish Employer did not ensure employees used appropriate respirators to protect against Valley Fever. It failed to establish Employer exposed employees at the worksite to the hazard of dust containing Valley Fever spores, or that Employer’s engineering controls were ineffective in controlling and eliminating the risk of such exposure.
