VIOLATION – SERIOUS CLASSIFICATION
Labor Code §§ 6432(a), (b), (c) (2021) – Employer did not contest its violation of §3441(a)(2)(D), failure to ensure all employees were clear of agricultural equipment when it was being operated. However, the ALJ reclassified the citation from serious to general, due to lack of employer knowledge, and modified the penalty accordingly.
