FOURTH AMENDMENT - CONSENT TO INSPECTION
The Division’s inspection did not violate Employer’s Fourth Amendment rights. Employer’s foreman did not refuse to speak to the Division’s inspector or insist that a warrant be obtained.
INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) - CODE OF SAFE PRACTICES (CSP)
Cal. Code Regs, tit. 8, § 1509(c) (2012) - Employer failed to have a copy of its CSP onsite or in the foreman’s truck at the time of the inspection.
DEMOLITION - WRITTEN SURVEY
Cal. Code Regs, tit. 8, § 1734(b)(2) (2012) - Employer failed to have a copy of its demolition survey onsite or in the foreman’s truck at the time of the inspection.
DEMOLISHING BUILDINGS - DUST CONTROL
Cal. Code Regs, tit. 8, § 1735(t) (2012) - Employer did not make provisions for the control of dust that included the use of water to keep material or debris sufficiently wet during demolition of a building.
DEMOLITION - SUPERVISION BY QUALIFIED PERSON
Cal. Code Regs, tit. 8, § 1734(a) (2012) - Employer’s demolition work was not under the immediate supervision of a qualified person.
DEMOLITION - SURVEY OF STRUCTURE BY QUALIFIED PERSON
Cal. Code Regs, tit. 8, § 1734(b)(1) (2012) - A survey of the structure to be demolished was not made by a qualified person prior to permitting employees to start demolition operations.
DEMOLISHING BUILDINGS - CONTINUING INSPECTIONS TO DETECT HAZARDS
Cal. Code Regs, tit. 8, § 1735(d)(4) (2012) - Employer did not make continuing inspections of the structure to detect hazards as the demolition work progressed.

Cal. Code Regs, tit. 8, § 1735(n) (2012) - Employer did not dismantle the structure column length by column length, and tier by tier, which caused the structure being demolished to be overstressed.
