Unshored Excavation. Appellant was found in serious violation of 1540(b) where employees were exposed to an inadequately shored or sloped excavation at a construction site. The violation was classified as serious, since death or serious bodily harm could result and the Appellant knew of the existence of the hazard. An $800 penalty was affirmed.
