The matter was settled at the hearing when the Division moved to withdraw citations alleging general violations of 2395.45(a)(4) and 2340.23(a), on the grounds that it had insufficient evidence to establish its burden of proof. The Division also moved to reduce the penalty from $880 to $500 for a general violation of 4070(a) and the Employer withdrew its appeal.
