Employer, a subcontractor specializing in concrete and wall cutting, was inspected after an employee fell from the second floor of a building undergoing renovation. The Division cited a serious violation and proposed a $4,000 penalty. Employer appealed the violation and penalty and also contended that it did not create the hazard.
