PENALTIES - FINANCIAL HARDSHIP
Employer's financial hardship was partially established, but not to a point showing that paying any penalties would force it out of business. In addition, it did not establish that it had abated all of the violations. The duplicative penalties for numerous confined space violations were reduced, as they had been abated. The remainder were affirmed as proposed. The final total was made payable over 24 months.
