EXCAVATIONS AND TRENCHES - PROTECTION FROM CAVE-INS
CAL. CODE REGS, tit. 8, § 1541.1(a)(1) (2002) - While their foreman was away, a pipe-laying crew removed shoring to allow a laborer to shovel dirt into the bucket of an excavator. A cave-in seriously injured him. Because reasonable diligence was not exercised by Employer, shown by the fact that the shoring had been improperly installed to begin with, the serious, accident-related violation was upheld.
