LOG OF WORK-RELATED INJURIES AND ILLNESSES – DESCRIPTION OF INJURY OR ILLNESS California Code of Regulations, title 8, § 14300.29(a) (2019) – The Employer’s Form 300, itself, constituted evidence of the violation that Column F of the Form 300 was not filled out on more than one occasion. METAL SCAFFOLDS – SECURE ATTACHMENT OF RAILINGS California Code of Regulations, title 8, § 1644(a)(6) (2019) – A securely attached guardrail must be connected or joined in a manner rendering it free from danger and affording safety. Following the plain meaning of these terms, the ALJ determined evidence showed  at least one guardrail at the location where the injured employee worked was not securely attached. METAL SCAFFOLDS – Erection and Dismantling GOOD ENGINEERING PRACTICE California Code of Regulations, title 8, § 1637(k)(2)(2019) -  Erection and dismantling of scaffolds shall be performed in accordance with good engineering practice. In this case, the ALJ determined that using No. 12 gauge wire to secure the top of a guardrail was a not a “good engineering practice.” ASSESSMENT OF CIVIL PENALTIES The three Citations, including the classification of Citation 2 as Serious-Accident Related, were affirmed and associated penalties of $19,000 assessed.
