GUARDING OF ENERGIZED PARTS – ELECTRIC EQUIPMENT OPERATING AT 50 VOLTS OR MORE
Cal. Code Regs, tit. 8, § 2340.17(a) (2015) – Employer’s employees were more likely than not exposed to unguarded live electrical wires. Proof of actual exposure was not necessary to establish a violation.
INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – REQUIRED ELEMENTS
Cal. Code Regs, tit. 8, § 3203(a) (2015) – Employer’s IIPP did not contain all required elements; specifically, it lacked provisions for how Employer would correct new hazards in the workplace, and its communication system.
INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – EVALUATION AND IDENTIFICATION OF WORKPLACE HAZARDS
Cal. Code Regs, tit. 8, § 3203(a)(4) (2015) – Employer did not implement its IIPP to effectively identify and evaluate workplace hazards; specifically, identifying and evaluating the hazards of operating an all-terrain vehicle (ATV) that it had modified. The Division established a serious violation.
INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – TRAINING ON WORKPLACE HAZARDS
Cal. Code Regs, tit. 8, § 3203(a)(7) (2015) – Employees working on telephone communications lines routinely used an ATV in remote, ungraded hillsides, mountains and canyons; however, Employer failed to provide them with training and instruction, either before or after the vehicle was modified, to adequately identify and evaluate the hazards associated with operating the vehicle.
MACHINERY AND EQUIPMENT – IMPROPER VEHICLE MODIFICATIONS
Cal. Code Regs, tit. 8, § 3328(f) (2015) – Employer’s employees were exposed to the hazard of operation of a vehicle with modifications that were not authorized by the manufacturer or in accordance with good engineering practice. The Division established a serious, accident-related violation.
PERSONAL PROTECTIVE EQUIPMENT – HAZARD ASSESSMENT AND EQUIPMENT SELECTION
Cal. Code Regs, tit. 8, § 3380(f)(1) (2015) – Employer’s employees were exposed to the hazard of operation of a vehicle without personal protective equipment provided by Employer, a serious, accident-related violation.
TELECOMMUNICATIONS – VEHICLE-MOUNTED MATERIAL HANDLING DEVICES AND OTHER MECHANICAL EQUIPMENT
Cal. Code Regs, tit. 8, § 8610(c) (2015) – Employer’s employees were exposed to the hazard of operation of a vehicle that did not have a roll-over protective structure (ROPS), a serious violation.
