Cal. Code Regs, tit. 8, § 3276(e)(15)(E) (2014) – Employer failed to ensure that an employee did not use the step below the topcap of the ladder to access the top of a shade structure.
FALL PROTECTION – HEIGHT IN EXCESS OF SEVEN AND ONE-HALF FEET
Cal. Code Regs, tit. 8, § 1670(a) (2014) – Employer failed to ensure that an employee used fall protection when working at a height in excess of seven and one-half feet, thus exposing the employee to the hazard of falling. Employer failed to establish the independent employee action defense.
