PENALTIES - FAILURE TO REPORT SERIOUS INJURY
Cal. Code Regs, tit. 8, § 342(a) (2010) - Employer’s reporting violation was established by operation of law. However, the ALJ deemed the proposed $5,000 penalty excessive and unreasonable, and reduced it to $2,500. 

FINANCIAL HARDSHIP
The evidence did not establish that Employer’s financial hardship warranted penalty elimination, although it warranted a reduction of 50 percent.
