HAZARDOUS ENERGY CONTROL – CLEANING, REPAIRING, SERVICING, SETTING-UP AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT
Cal. Code Regs, tit. 8, § 3314(c) (2014) – A violation existed because a printing press was not locked out/tagged out when an employee reached into the machine to clean, service and adjust it by removing debris, and he was exposed to the dangerous condition of having his hand entangled in the press. However, Employer established the independent employee action defense.
INDEPENDENT EMPLOYEE ACTION DEFENSE (IEAD)
Employer established all elements of the IEAD with respect to its employee’s failure to follow lockout/tagout procedures on a printing press.
